Terms of Service

These Terms of Service ("Terms") are an agreement between you and TrackSims ("TrackSims", "we", "us") — a sole proprietorship based in Canada, and the operator of the website at tracksims.com and its related services (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

TrackSims is a motorsport analytics and statistics platform. It presents historical data, statistics, visualizations, and model-based projections relating to Formula 1 and other motorsport, for informational and entertainment purposes.

TrackSims is not a gambling or betting service. We do not accept, place, broker, or facilitate bets or wagers of any kind, we do not handle betting funds, and nothing on the Service is an offer or invitation to gamble.

All data, statistics, and projections on the Service are provided for general information only. Projections are model outputs based on historical data; they are estimates, not predictions of fact, and actual results will differ. We make no guarantee of the accuracy, completeness, or timeliness of any data or projection.

Nothing on the Service constitutes betting, financial, or professional advice, and no content should be relied on as such. Any decision you make based on content from the Service — including any wagering decision made with a third party — is made entirely at your own risk. You are solely responsible for complying with the laws that apply to you in your location.

You must be at least 18 years old (or the age of majority where you live, if higher) to create an account. Some features require an account, which you register with an email address. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate registration information and to notify us of any unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used unlawfully.

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law;
• scrape, harvest, or bulk-download data from the Service, or access it by automated means other than public search engines, without our prior written consent;
• resell, redistribute, or commercially exploit the Service or its data without our prior written consent;
• interfere with or disrupt the Service, probe or circumvent its security, or impose an unreasonable load on our infrastructure;
• misrepresent your affiliation with TrackSims, or use the Service to mislead others;
• share your account or use another person's account without permission.

The Service — including its software, design, text, graphics, visualizations, models, and the selection and arrangement of data — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. No other rights are granted.

Formula 1 and related marks are trademarks of their respective owners. TrackSims is an independent platform and is not affiliated with, endorsed by, or sponsored by Formula One Group, the FIA, or any team.

Much of what the Service displays is derived from material published by other people. That includes Formula 1 timing, telemetry and results data obtained through open-source and public interfaces; historical results from public motorsport results APIs; betting odds published by bookmakers and prediction markets; daily-fantasy salary information published by DraftKings; documents published by the FIA; headlines, links and quotes from motorsport news outlets; driver and team imagery; and circuit photographs published under Creative Commons licences.

Those names, marks, images, and underlying data belong to their owners. We claim no rights in them, and nothing on the Service grants you any rights in them. If you own material shown on the Service and want it removed, email us at the address in Section 16.

TrackSims is independent. It is not affiliated with, endorsed by, or sponsored by Formula 1, the FIA, any Formula 1 team, DraftKings, or any bookmaker or betting exchange.

We do not control third-party data and are not responsible for errors, omissions, or delays in it. Some figures shown alongside it — projections, derived statistics, and modelled salary estimates — are produced by our own models rather than published by the third party. The Service may also link to third-party websites or services; we are not responsible for their content or practices, and your use of them is governed by their own terms.

We may offer paid subscriptions or features in the future. If we do, the price, billing period, and any additional terms will be presented to you before you pay, and payments will be handled by a third-party payment processor subject to its own terms. Unless stated otherwise at the point of purchase, paid features are subject to these Terms. Where required by the law that applies to you, you may have statutory cancellation or withdrawal rights that these Terms do not limit.

The Service is provided on an "as available" basis. We may change, suspend, or discontinue any part of the Service at any time, including free features, without liability to you. We do not guarantee that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, the Service and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service — including any loss arising from reliance on data or projections shown on the Service. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose and (b) 50 US dollars (or the equivalent in your local currency).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service, to the extent permitted by applicable law.

You may stop using the Service at any time, and you may ask us to delete your account by emailing the address in Section 16. We may suspend or terminate your access to the Service if you breach these Terms or where required by law. Sections that by their nature should survive termination (including Sections 6, 7, 10, 11, 12, and 14) will survive.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Subject to any mandatory consumer protections in your country of residence, the courts of British Columbia will have exclusive jurisdiction over disputes arising out of these Terms or the Service.

We may update these Terms from time to time. If we make material changes, we will give notice by posting the updated Terms on this page and updating the "Last updated" date, and, where the change is significant, by additional notice such as email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
